Blue Haven Separation is a separation support and educational service founded by Jade Hopper, a former family lawyer with more than a decade of experience in the legal industry.
Blue Haven provides practical support, educational resources, templates and personalised sessions to help people navigate the practical challenges of separation.
Blue Haven Separation is not a law firm and is not a registered legal practice. Blue Haven does not act as your lawyer, provide legal representation or appear on your behalf in court.
Although our services are informed by experience in the legal industry, Blue Haven does not provide legal advice tailored to your individual circumstances.
Nothing in our services or resources is intended to create a lawyer–client relationship.
-
All information, resources, templates, tools, sessions and other services provided by Blue Haven are intended to offer general information, education and practical support.
They do not constitute legal advice and must not be relied upon as a substitute for independent legal advice from an appropriately qualified Australian legal practitioner.
Blue Haven does not:
Advise you on your individual legal rights, obligations or entitlements.
Assess the legal merits of your circumstances or determine the likely outcome of a legal dispute.
Interpret court orders or provide advice about their enforcement.
Advise you whether to commence, defend or discontinue court proceedings.
Act as your legal representative or communicate with another party on your behalf as your lawyer.
Appear for you in court or tribunal proceedings.
Guarantee that a particular agreement, document, letter or approach will be legally effective or achieve a particular outcome.
Where your circumstances require legal advice, you should consult an appropriately qualified Australian legal practitioner.
You remain responsible for obtaining independent legal advice where necessary and for all decisions you make concerning your separation.

-
We understand that circumstances can change and that you may occasionally need to cancel or reschedule an appointment.
Our cancellation and rescheduling policy is intended to provide clarity about the arrangements that apply to bookings.
Cancellation more than 24 hours before an appointment
If you cancel more than 24 hours before your scheduled appointment, any payment already received will be dealt with in accordance with the applicable cancellation terms and refund requirements.
Cancellation within 24 hours of an appointment
Where you cancel within 24 hours of your scheduled appointment, the appointment fee will generally remain payable and will not be refunded, except where a refund or other remedy is required by law.
Failure to attend
If you do not attend your appointment or are unavailable when we attempt to contact you at the scheduled time, the appointment will be treated as a missed appointment. The appointment fee will generally remain payable, except where a refund or other remedy is required by law.
Rescheduling an appointment
If you need to change your appointment, please provide as much notice as possible.
Rescheduling requests are subject to availability. Any applicable cancellation or rescheduling charges will be communicated before a change is confirmed.
Cancellations by Blue Haven
If we need to cancel or reschedule an appointment, we will contact you as soon as reasonably practicable to arrange an alternative appointment or applicable refund.
Nothing in this policy excludes or limits your rights under the Australian Consumer Law.
-
We want you to have a positive experience when engaging with Blue Haven.
However, we understand that circumstances may change and that there may be occasions when you request a refund.
Our refund arrangements are as follows:
Appointments and sessions
Appointment fees are generally non-refundable where you cancel within 24 hours of the scheduled appointment or fail to attend.
Where an appointment is cancelled by Blue Haven, we will offer an alternative appointment or refund, as appropriate.
Digital products and downloadable resources
Due to the nature of digital products, refunds are not generally available simply because you change your mind after purchasing or accessing a resource.
However, if a digital product is faulty, inaccessible, not as described or otherwise fails to meet an applicable consumer guarantee, you may be entitled to a remedy.
Services and other purchases
Refund requests will be considered in accordance with the nature of the service or product purchased and your rights under applicable consumer law.
Nothing in these terms excludes, restricts or modifies any consumer rights or remedies that cannot lawfully be excluded, restricted or modified.
-
Where you purchase a letter or document preparation service, the work will be undertaken based on the information and instructions you provide.
You are responsible for ensuring that:
The information and instructions you provide are complete and accurate.
All relevant background information is disclosed.
You review the prepared material carefully.
The final document accurately reflects your intended communication.
You decide whether and how to use or send the prepared material.
The service inclusions, page limits, timeframes and number of amendments will be specified in the relevant product description.
Unless otherwise stated, one round of minor amendments is included. Substantial changes to your original instructions, additional work or changes to the scope may incur an additional fee, which will be discussed with you before proceeding.
Blue Haven does not guarantee that any letter or document will achieve a particular outcome, be accepted by another party or be suitable for filing with a court or tribunal.
These services do not include legal advice, assessment of legal rights or representation.
-
Blue Haven offers practical resources and support to help you prepare for mediation.
This may include assistance with organising information, identifying priorities, preparing your thoughts and considering the practical steps involved in mediation.
Where a support person is requested to attend mediation, attendance is subject to the mediator's approval and the applicable mediation arrangements.
Blue Haven does not act as your legal representative during mediation, negotiate on your behalf or provide legal advice during the process.
You remain responsible for your decisions, proposals and any agreements reached during mediation.
If you require legal advice about a proposed agreement or its legal consequences, you should obtain independent legal advice before agreeing to any terms.
-
To help us provide the services you have purchased, we ask that you:
Provide accurate and complete information.
Respond to reasonable requests for further information.
Treat our team respectfully and communicate appropriately.
Attend appointments at the agreed time.
Review all resources and prepared material before using them.
Make your own decisions about your circumstances.
Seek independent legal advice where required.
Blue Haven reserves the right to decline, suspend or discontinue a service where it is outside our scope, where we do not have the capacity or expertise to assist, or where continuing the service would be inappropriate.
Where possible, we will explain the reason and identify an appropriate alternative source of assistance.
-
Every separation is different, and outcomes depend on individual circumstances, the decisions of the people involved and, where relevant, the actions of other parties, mediators, courts and government agencies.
Blue Haven does not guarantee:
That an agreement will be reached.
That another party will respond to or accept correspondence.
That mediation will be successful.
That a particular proposal will be accepted.
That a document will be accepted by a court, tribunal or other organisation.
That using our resources or services will result in a particular financial, parenting or legal outcome.
Our role is to provide practical support and educational resources to help you feel more organised and prepared.
